ORLANDO, Fla. (AP) — The shakeup of Walt Disney World's governing district more than a year after it was taken over by Gov. Ron DeSantis' appointees continued Wednesday with the departure of its board chairman who had been highly critical of Disney. In an email, DeSantis' communications director, Bryan Griffin, thanked Garcia for “successfully navigating” the transition of the district from a governing body controlled by Disney supporters to the current iteration controlled by DeSantis appointees. As punishment for opposition to the law, DeSantis took over the district through legislation passed by the Republican-controlled Florida Legislature and appointed a new board of supervisors. Disney sued DeSantis and his appointees, claiming the company’s free speech rights were violated for speaking out against the legislation.

ORLANDO, Fla. (AP) — The court fight between Disney and Florida Gov. Ron DeSantis' appointees over control of Walt Disney World's government won't be decided until at least this summer, provided the two sides don't reach a settlement beforehand. A hearing over whether the state court case should move forward or be decided without the need for a full trial was set last week for July 25 in Orlando. Disney claims the Republican governor and his appointees took over the district, which provides government services like planning and firefighting at Disney World, in retaliation for the company opposing Florida's so-called “Don’t Say Gay” law. DeSantis and his appointees to the governing district had a first-round victory in the multiple court fights over the takeover when a federal judge in Tallahassee in January dismissed Disney’s free speech lawsuit against them.

ORLANDO, Fla. (AP) — Disney on Thursday appealed a judge's dismissal of its free speech lawsuit over what it described as Gov. A separate lawsuit over who controls the district also is still pending in state court in Orlando. Disney had argued that legislation signed by DeSantis and passed by the Republican-controlled Legislature transferring control of the Disney World governing district from Disney supporters to DeSantis appointees was in retaliation for the company publicly opposing the state’s “Don’t Say Gay” law. Before control of the district changed hands from Disney allies to DeSantis appointees early last year, the Disney supporters on its board signed agreements with Disney shifting control over design and construction at Disney World to the company. Disney has filed counterclaims that include asking the state court to declare the agreements valid and enforceable.

The legal filings marked an escalation in the battle between the entertainment giant and DeSantis, a candidate for the 2024 GOP presidential nomination. Ron DeSantis to oversee Walt Disney World's special tax district asked a state court to dismiss Disney 's bid to recover damages over a breach of contracts counterclaim. "All of Disney's counterclaims fail as a matter of law," attorneys for the district board wrote in a court filing Wednesday in circuit court in Orange County, Florida. That's mainly because Disney's contracts are "void as a matter of Florida law and therefore have never had any legal force or existence," the board wrote. Shortly thereafter, DeSantis, who signed the Republican-backed legislation, targeted the special district that had allowed Disney to effectively self-govern its Orlando-area theme parks for decades. The DeSantis-backed board members had voted to nullify Disney's contracts after accusing the company of trying to undermine the new board's authority and sneaking the deals through right before the change in leadership took place.

Disney on Thursday amended its federal lawsuit against Florida Gov. Ron DeSantis to focus solely on its First Amendment claim that the governor politically retaliated against the company. Disney had already amended its lawsuit once in May to accuse DeSantis and his allies of doubling down on their attacks. DeSantis has leaned into culture-war battles as governor and on the campaign trail, as he seeks the 2024 Republican presidential nomination. He has tarred Disney with the politically loaded term "woke" and accused the company of "sexualizing children" — a claim Disney CEO Bob Iger called "preposterous and inaccurate."

Spokespeople for the board and Disney did not immediately respond to CNBC's requests for comment. Disney's requests came in a 55-page filing denying the district board's allegations in its state-level lawsuit against the entertainment giant. The company seeks damages over the alleged breach, as well as a court order for the district to comply with development contracts that are at the heart of the legal fight between Disney and DeSantis. Disney has filed counterclaims, including a breach of contracts claim, against the board of supervisors picked by DeSantis to oversee Walt Disney World's special tax district, a Thursday court filing shows. Disney (DIS) reported fiscal third-quarter results after the closing bell Wednesday, and it was another mixed quarter even against low expectations. Still, there were enough pockets of optimism in the company's restructuring plan and streaming strategy to believe CEO Bob Iger's turnaround is working. Indeed, global Disney+ subscribers declined to 146.1 million from 157.8 billion, but nearly all of that was associated with Disney+ Hotstar and not Disney's core markets. Quarter over quarter, that loss of $512 million was narrower by $147 million. Thanks to the ongoing strength of Disney's international parks and cruise line business, Disney expects fourth-quarter operating margins at DPEP to exceed the prior year.

A judge ruled Friday that a lawsuit against Disney in Florida would proceed. The case relates to a legal loophole used by Disney to take back control of its operations in Florida. The park argued that the case is "moot" in state court because of a DeSantis law that voided development agreements Disney signed up to three months before the appointed board was created, PBS reported. The ruling marks another legal punch in the year-long fight between DeSantis and Disney. As a result, the newly appointed DeSantis board was stripped of its power.

DeSantis asked a federal judge to dismiss Disney's lawsuit against him, claiming he has immunity. The lawyers for the Florida governor also said Disney had no business filing in federal court. Ron DeSantis of Florida filed a motion in federal court Monday evening asking a judge to dismiss Walt Disney World's lawsuit against him. Disney's lawsuit accuses DeSantis and his office of engaging in "a targeted campaign of government retaliation" against Disney that was "orchestrated at every step by Governor DeSantis as punishment for Disney's protected speech." Attorneys for the governor said in the 27-page motion that the federal district Disney filed the lawsuit in lacks jurisdiction.

A sign near an entrance to Walt Disney World on May 22, 2023 in Orlando, Florida. Ron DeSantis recused himself from the case Thursday, days after learning that one of his relatives owns stock in The Walt Disney Company . Judge Mark Walker made the decision to remove himself from the case despite denying DeSantis' motion for him to be disqualified. While the judge did not identify the relative by name or relationship, third-degree relatives include great-grandparents, great grandchildren, great uncles and aunts as well as first cousins. Disney's allegations make clear that this case "involves significant economic interests for its parent corporation, in which my third-degree relative owns stock," the judge wrote.

Insider turned to Disney CEO Bob Iger's 2019 book for insight on how he navigates challenges. As Florida's largest attraction with more than 70,000 jobs, Walt Disney World is crucial to both the company and the state. During his first tenure at Disney, Iger orchestrated the $4 billion acquisition of Marvel without a single leak. Under predecessor Disney CEO Michael Eisner, board members said they worried that Marvel was "too edgy" and "would tarnish the Disney brand." File photo of Disney CEO Bob Iger.

Disney's decision to scrap its $1 billion campus could affect projects nearby. CoStar Group told The Wall Street Journal that thousands of homes were built after Disney announced its campus in 2021. However, the development group that owns the land says that Disney's decision will not affect it. Hundreds of employees set to work at the new campus had already moved to Lake Nona before Disney announced they would be abandoning the plan. They also told the Journal that 95% of the multifamily housing at Lake Nona is currently being occupied.
Disney on Tuesday asked a Florida court to dismiss a lawsuit by the board of supervisors that Gov. By signing that legislation, DeSantis essentially carried out the same action that the board is asking the court to take, Disney argued. Disney filed suit after the board voted to undo development contracts that the company says it struck to secure its investments. Disney expanded its lawsuit last week, accusing DeSantis of doubling down on his political vendetta by signing legislation to void Disney's development deals in Orlando. In March, the district's new slate of supervisors accused Disney of crafting "11th-hour" development deals intended to thwart the board's power over the 25,000-acre area.
The Walt Disney Company isn't the only business in Florida that operates within a special district, CEO Bob Iger reminded investors Wednesday. "The case that we filed last month made our position and the facts very clear," he said during an earnings call. Disney's amended lawsuit also noted that Florida's Republican-led Legislature passed legislation last week targeting Walt Disney World's monorail system. He said the company is the largest taxpayer in central Florida, having paid more than $1.1 billion in state and local taxes last year. "So this is plainly a matter of retaliation while the rest of the Florida special districts continue operating basically as they were."

Disney's amended lawsuit also noted that Florida's Republican-led legislature passed legislation last week targeting Walt Disney World's monorail system. On Friday, the final day of the state's 2023 legislative session, DeSantis signed a bill that included language effectively targeting Disney's development contracts. Linda Stewart, a Democrat representing Florida's 13th Senate district and a staunch critic of DeSantis' actions against Disney, called the feud between DeSantis and Disney "insane" and laid blame with her Republican counterparts.
Florida Governor Ron DeSantis speaks during a conference titled "Celebrate the Faces of Israel" at Jerusalem's Museum of Tolerance, on April 27, 2023. Measures like the restrictive abortion law DeSantis signed could help him in a GOP primary, but may reduce his appeal in a general election. Lawmakers have also passed multiple measures that could help clear DeSantis' path to the White House, if and when he decides to run. "The entire session was focused on Governor DeSantis' run for president," said Jim Clark, a University of Central Florida senior lecturer and political commentator, in an interview. On top of those issues, DeSantis in March waded into the "school choice" debate by signing a bill expanding Florida's school voucher system.
